Consignment Terms & Conditions

1. Agreement Acceptance

By submitting Artwork for consideration and/or by paying the entry fee, the Artist acknowledges that they have read, understood, and agreed to abide by these Consignment Terms & Conditions.

2. Definitions

  • Ebb + Flow: Refers to the gallery accepting consigned artwork under this agreement.
  • Artist: The individual submitting Artwork for consignment.
  • Artwork: The work(s) of art submitted by the Artist for consignment.
  • Consignment Period: The duration for which the Artwork will be held by Ebb + Flow is typically 45 days unless otherwise specified. 

3. Selection and Notification

3.1 Ebb + Flow will consider Artwork that has been submitted through an Entry Form completed to the satisfaction of the gallery.

3.2 Selection of Artwork is at the sole discretion of Ebb + Flow.

3.3 Artists whose Artwork has been selected will be notified via email.

4. Artwork Preparation and Delivery

4.1 Artists are responsible for ensuring their Artwork is ready for display, including the installation of d-rings and hanging wire.

4.2 Artworks should be securely framed or appropriately prepared for exhibition, as per Ebb + Flow’s guidelines.

4.3 Artists are responsible for the cost and arrangement of delivering their Artwork to Ebb + Flow by the specified deadlines.

4.4 Any damage or loss of Artwork during transit is at the risk of the Artist.

5. Display and Presentation

5.1 Ebb + Flow reserves the right to determine the layout, arrangement, and positioning of Artworks within the exhibition space.

5.2 Ebb + Flow will provide a standard hanging system. If Artwork requires a special hanging or display system, the Artist will provide the special system.

5.3 Any specific display requirements or instructions should be communicated to Ebb + Flow in advance.

5.4 If Artwork is delivered to Ebb + Flow and deemed unsuitable for hanging, the gallery may opt to keep the Artwork in storage or request the Artist to adjust the hanging system.

6. Insurance and Liability

6.1 Ebb + Flow will take reasonable care in handling and displaying Artworks; however, the Artist agrees to hold Ebb + Flow and its subcontractors harmless for any damage, loss, or theft of Artwork exhibited.

6.2 Ebb + Flow maintains general insurance; however, it is the Artist’s responsibility to insure the Artwork for loss, damage, or other risks while in the possession of Ebb + Flow.

6.3 The Artist may opt not to insure their Artwork, but that decision is at their sole discretion, and the Artist agrees not to make any claim against Ebb + Flow’s insurance.

7. Copyright

7.1 By submitting Artwork for consignment, the Artist grants Ebb + Flow a non-exclusive, royalty-free, worldwide license to reproduce, display, distribute, and use images of their Artwork for marketing and promotional purposes related to the promotion of Ebb + Flow and its exhibitions. This may include use in press releases, advertising, social media, website content, catalogues, and other promotional materials.

8. Consignment and Commission

8.1 During the Consignment Period, ownership of the Artwork shall remain with the Artist unless sold. Ebb + Flow holds physical possession of the Artwork on a consignment basis.

8.2 Unless otherwise specified, Ebb + Flow will retain a 30% commission on any sales of consigned Artwork.

8.3 Payments made to Ebb + Flow during the Consignment Period shall be processed according to the gallery’s standard payment schedule following the conclusion of the Consignment Period.

8.4 Additional costs such as EFTPOS fees, Artist-approved discounts, or unpaid postal charges will be deducted from the Artist’s payment and detailed on a remittance advice.

9. Delivery and Collection

9.1 The Artist is responsible for the delivery, insurance, packaging, and transport of their Artwork to and from Ebb + Flow.

9.2 The Artist agrees to consult and obtain consent from Ebb + Flow before using any equipment in the gallery space.

9.3 At the end of the Consignment Period, Ebb + Flow will nominate a time for collection of unsold Artwork.

9.4 Uncollected Artwork will be moved into general storage and subject to a storage fee as per Ebb + Flow’s Uncollected Storage Policy.

10. Storage and Uncollected Artwork

10.1 If storage fees remain unpaid for more than 30 days, or if the Artwork remains uncollected for over one year post-exhibition, Ebb + Flow reserves the right to assume ownership of the Artwork in lieu of fees owed.

11. Publicity and Promotion

11.1 The Artist agrees that Ebb + Flow may use any of the Artist’s intellectual property, including copyrights and trademarks, for publicity related to their exhibition or for future gallery promotions.

12. Liability and Indemnity

12.1 The Artist agrees to indemnify and hold harmless Ebb + Flow, its staff, contractors, and agents against any claims, losses, damages, or costs resulting from the Artist’s breach of these terms or wrongful conduct.

13. Amendments

13.1 These terms and conditions are subject to change without notice. The latest version will be posted on the Ebb + Flow website and take effect immediately.
